| 1. | SCOPE AND REGIMEN |
| The rules of use of the site www.charmcomfort are in accordance with the present Terms and Conditions of Use, according to the Portuguese Law. |
| 2. | DEFINITIONS, INTERPRETATION AND EXECUTIONS OF TERMS AND CONDITIONS |
| 2.1. | Whenever Terms and Conditions are written or expressed in capital letters, and except when the text relates to something different, the terms mentioned forward will have the following meaning: |

Luso Guias – Edições, Lda., legal person nº 505741358, with its head-office in Lisbon; |
| (B) User: |
Everyone that visits the site www.charmcomfort.com and uses the information, products or services available; |
| (C) SITE: |
Web site www.charmcomfort.com, interactive tourist directory and property of LUSO GUIAS; |
| (D) CLIENT: |
Tourist entity that promotes its services through the site www.charmcomfort.com; |
| (E) SERVICES |
Diverse tourist contents and services available at the SITE. |

| 2.2. | The present TERMS AND CONDITIONS reflect and combine in full the agreed between the Parties concerning its purpose, cancelling all type of previous oral or written agreements. |
| 2.3. | The non-exercise or the delayed or partial exercise of any right to the Parties according to these TERMS AND CONDITIONS do not imply the renunciation to that right neither prevents its subsequent exercise. |
| 3. | GOAL |
| 3.1. | LUSO GUIAS has created and maintains the SITE to allow the User access and use of different contents and services related to tourism (Services). |
| 3.2. | LUSO GUIAS is responsible for the fulfilment of the mentioned in the previous paragraph: |

To assure the existence and maintenance of the SITE within the World Wide Web; |
| (b) |
To update the data concerning the many Services available in the SITE, the categories: hotels, manor houses & farms, restaurants, bars and coffees, golf, hunting, art, culture and leisure, shopping, health, beauty and others; |
| (c) |
To render a support service to the User; |
| (d) |
To render an on-line reservations service to some Services depending on the agreement between the Client and LUSO GUIAS. |

| 4. | RESERVATIONS AND COMMISSIONS |
| 4.1. | As an intermediary between the User and the Client, the SITE provides an on-line reservation request Service, whose conditions the SITE advises to be requested to the Client and previously read by the User. |
| 4.2. | The Client is responsible for the reservation conditions and will guarantee its content before the User as well as eventual errors, omissions or changes regarding the Service. The Client is exclusively responsible for confirming the reservation to the User. |
| 4.3. | If the User intends to cancel a reservation already confirmed by the Client, he may have to pay an extra rate for the service lent. |
| 5. | PERSONAL DATA PROTECTION |
| 5.1. | The privacy and protection of the User’s registered data is safeguarded by the Law of Protection of Personal Data and is wisely respected by the responsible for the SITE’s data treatment and may not be disclosed nor revealed to third parties. |
| 5.2. | If requested by the User, the SITE can send by mail specific and prominent information about the Services, and that request can be cancelled by sending e-mail to the SITE. |
| 5.3. | The User may always consult or correct, his personal data, as long as this is done through the e-mail indicated in its registry, for better safeguard of his interests. |
| 6. | SITE CONTENTS DISCLAIMER |
| 6.1. | LUSO GUIAS assumes from the beginning the responsibility for all the information contained in the SITE, created by it, namely, routes, news and headlines. |
| 6.2. | The Client is the sole responsible for all other contents available on the SITE namely prices, discounts, characteristics of the places, typology, quality of the Services and its changes. |
| 6.3. | The SITE undertakes to update the contents referred in the last paragraph and report any eventual changes to the Users, as soon as possible, without assuming any kind of responsibility regarding it. |
| 7. | RESPONSIBILITY OF LUSO GUIAS |
| 7.1. | LUSO GUIAS is only responsible for the damages caused to the User as a direct consequence from the use of the SITE, when such damages can be solely attributed to its fraudulent performance. |
| 7.2. | LUSO GUIAS is not responsible for the damages or losses that may arise from interferences, omissions, interruptions, data processing virus, and electronic system breakdown, caused by the User when using the SITE’s Services, caused by reasons foreign to LUSO GUIAS. |
| 8. | LINKS |
| 8.1. | The SITE can mention or connect to other sites (Links) but is not responsible for the content nor the connections that those other sites may have. |
| 8.2. | The existing or referred Links in the SITE serve reasons of convenience and do not imply the signing in, opinion or evaluation, positive or negative, by LUSO GUIAS regarding its quality. |
| 9. | NONFULFILMENT |
| 9.1. | If the User infringes any of the rules mentioned in the Terms and Conditions, is liable to the legal consequences- penal and civil, that may come from that infringement, namely to serve a sentence and/or to pay an indemnity to the SITE or to third party injured for the damages caused. |
| 9.2. | If any of the Terms and Conditions here mentioned is infringed, any USER must inform the SITE by e-mail geral@charmcomfort.com. |
| 10. | MODIFICATION OR SUSPENSION OF TERMS AND CONDITIONS |
| The SITE has the right, at any time, to modify or to change the Terms and Conditions as well as the SITE. Whenever possible, the SITE will inform the Users of the changes made. |
| 11. | INTELECTUAL PROPERTY RIGHTS |
| As in the Code of Author’s Right and the Connected Right, the SITE and all its content are protected by the lawful precepts of intellectual property, by what the User is prohibited, without express authorization of the titular of those rights, copy, imitate, reproduce, change, use, trade or infringe in any other way those rights. |
| 12. | COMMUNICATION |
| The User may contact with the SITE, whenever necessary, by e-mail mentioned in the SITE. |
| 13. | LAW AND JURISDICTION |
| For resolution of any disputes of the TERMS AND CONDITIONS, the Parties agree to submit themselves to the Portuguese Law and to the jurisdiction of Lisbon any other being expressly waived. |
